Penang Factory Fined RM120,000 After Two Workers Lose Their Hearing
A manufacturer in Butterworth, Penang was fined RM120,000 after two employees were diagnosed with noise-induced hearing loss. The company had not carried out the noise controls its noise risk assessor called for.
The case was brought by the Penang State Occupational Safety and Health Department (JKKP). The company was charged under Section 18B(2) of the Occupational Safety and Health Act 1994 for failing to follow the noise risk assessor's instructions to put engineering controls in place — including noise barriers around the machinery area.
Offences like this carry a maximum fine of RM500,000, up to 2 years' jail, or both.
What it means for employers: under the OSH (Noise Exposure) Regulations 2019, noisy workplaces need a Noise Risk Assessment by a DOSH-registered assessor — and the recommended controls must actually be carried out. Hearing loss from noise is permanent, so prevention is the only cure.
